OUT OF TIME – TERMS AND CONDITIONS OF SALE

These Terms and Conditions apply to all purchases made from Out of Time ("we", "us", "our").
By placing an order, you agree to these Terms and Conditions.
Out of Time creates and sells handmade jewellery, personalised jewellery, pet portraits, memorial items and other bespoke handmade products.
Orders are arranged directly with customers in person, by telephone, email, social media messaging or by any other agreed method. Where applicable, secure payment services may be provided through trusted third-party providers, including SumUp.
Nothing in these Terms and Conditions affects your statutory rights under UK consumer law.

2. Orders and Contract Formation
2.1 Product photographs, descriptions, prices and examples of previous work are provided for information purposes only and do not constitute a legally binding offer to sell.
2.2 Messages, comments, enquiries, quotations, estimates and informal discussions do not create a legally binding contract.
2.3 A legally binding contract is formed only when Out of Time confirms acceptance of your order.
2.4 We reserve the right to refuse or cancel any order before acceptance if:
- materials are unavailable;
- pricing information is incorrect;
- payment cannot be authorised;
- insufficient information has been supplied;
- fraudulent activity is suspected; or
- we are unable to fulfil the order.
3. Handmade and Bespoke Products
3.1 All products are handmade and individually created.
3.2 Minor variations in colour, texture, size, engraving, materials and appearance are natural characteristics of handmade products and do not constitute faults.
3.3 Product photographs are intended as a guide only. Colours may vary due to screen settings and lighting conditions.
4. Personalised Orders
4.1 Personalised items include:
- pet portraits;
- memorial items;
- personalised jewellery;
- engraved items; and
- custom commissions.
4.2 Customers are responsible for ensuring all information supplied is accurate, including names, dates, spellings, photographs and design instructions.
4.3 Once production has started, changes may not be possible and additional charges may apply.
5. Prices and Payments
5.1 All prices are shown in Pounds Sterling (£).
5.2 Delivery charges, where applicable, will be agreed before the order is confirmed.
5.3 Prices may change before an order is accepted.
5.4 Ownership of goods remains with Out of Time until full payment has been received.
6. Deposits and Production Diary Bookings
6.1 A deposit may be required for personalised or bespoke items.
6.2 The deposit secures your booking within our production diary and allows us to purchase materials and begin work.
6.3 A production diary booking means time specifically reserved to create your order and during that time we may be unable to accept other commissions.
6.4 The deposit amount will be agreed before work begins.
6.5 If you cancel before work starts and before materials are purchased, we may refund all or part of the deposit at our discretion.
6.6 Once any of the following has occurred, the deposit becomes non-refundable:
- materials have been purchased;
- design work has started;
- artwork preparation has begun;
- production has started; or
- a diary booking has been reserved.
6.7 Any remaining balance must be paid before collection or dispatch.
7. Delivery and Collection
7.1 Delivery dates are estimates only.
7.2 We are not responsible for delays caused by postal or courier services.
7.3 Risk passes to you once goods are delivered or collected.
8. Cancellation Rights
Standard Items
For non-personalised goods purchased at a distance, you may have a 14-day cancellation right under the Consumer Contracts Regulations 2013.
Personalised Items
Goods made to your specifications or clearly personalised are exempt from the 14-day cancellation right.
This includes pet portraits, memorial items and personalised jewellery.
Once work has begun, these orders cannot be cancelled unless faulty.
9. Faulty Goods
Nothing affects your rights under the Consumer Rights Act 2015.
If goods are faulty, not as described or not of satisfactory quality, you may be entitled to a repair, replacement or refund.
Please contact us within 48 hours of receiving damaged goods and provide photographs where possible.
10. Intellectual Property
All artwork, jewellery designs, photographs and creative content remain the property of Out of Time.
They may not be copied, reproduced or sold without written permission.
11. Photography and Social Media
We may photograph completed items for marketing and social media purposes.
If you do not wish your item to be featured, please tell us before work begins.
We will not publish your personal contact details without your consent.
